TradeTable — Terms of Use

These Terms of Use ("Terms") are a binding agreement between you ("you," "your," or "User") and TradeTable LLC, a limited liability company organized under the laws of Montana ("TradeTable," "we," "us," or "our"), governing your access to and use of the TradeTable website and application and all related features (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE AN ASSUMPTION OF RISK (§ 7), A DISCLAIMER OF WARRANTIES (§ 8), A LIMITATION OF LIABILITY (§ 9), AND AN ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER (§ 14). THESE PROVISIONS AFFECT YOUR LEGAL RIGHTS.


1. Overview

TradeTable is a documentation and record-keeping tool for trading-card collectors. It lets you catalog your collection, view reference price information, and create shared, timestamped records of trades you arrange and carry out with other people in the real world. TradeTable helps you write down what happened. It does not conduct the trade for you. Please read § 4 carefully — what the Service is not is as important as what it is.

2. Acceptance of these Terms

By clicking "I Agree" (or a similar control), creating an account, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you accept on behalf of another person or an organization, you represent that you are authorized to bind them.

3. Eligibility and age requirements

  • You must be at least 13 years old to create an account.
  • You must be at least 18 years old (or the age of majority where you live), or have the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf, to (a) hold a paid subscription, or (b) initiate or record a trade.
  • The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we have, we will delete it. See the Privacy Policy.
  • By using the Service you represent that you meet these requirements and that all information you provide is accurate.

4. What the Service is — and what it is NOT

TradeTable is a passive documentation and record-keeping tool. For the avoidance of doubt, TradeTable is NOT, and does not act as, any of the following:

  • a party to any trade, sale, or other transaction between users;
  • an escrow, payment, or money-handling service (we never take custody of, hold, or transfer your money);
  • a broker, dealer, marketplace, consignment, or auction service;
  • a shipper or fulfillment service (we never take custody of your cards);
  • an authenticator, grader, appraiser, or certifier of any card's genuineness, condition, grade, or value; or
  • a provider of financial, investment, tax, or appraisal advice.

All trades happen directly between users, in the real world, on terms the users set themselves. TradeTable's only role is to let users create a record of what they say they agreed to and did. Any prices shown in the Service are reference estimates for informational purposes only, may be inaccurate, incomplete, or out of date, are drawn from third-party sources, and are not an appraisal, a guarantee of value, or financial advice.

5. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at [email protected] of any unauthorized use. You agree to provide accurate account information and to keep it current.

6. User conduct and content

You are solely responsible for the collection data, notes, trade information, photos, and other content you submit ("User Content"). You retain ownership of your User Content and grant us a limited, non-exclusive license to host, store, display, and process it solely to operate and provide the Service to you.

You agree that you will not:

  • knowingly trade, or use the Service to document the trade of, counterfeit, replica, stolen, or misrepresented cards, or engage in any fraud or deception;
  • misrepresent the identity, condition, authenticity, or ownership of any card;
  • use the Service for any unlawful purpose or in violation of any third party's rights;
  • upload malicious code, scrape the Service without permission, or interfere with its operation; or
  • post content that is unlawful, infringing, defamatory, or otherwise objectionable.

We do not pre-screen User Content and are not responsible for it, but we may remove content or suspend accounts that we believe violate these Terms.

7. Assumption of risk (trades are between users)

You understand and agree that every trade is a private transaction between you and another user, and that you assume all risks of dealing with other users. These risks include, but are not limited to, the possibility that a card is counterfeit, altered, misgraded, damaged, misrepresented, or not as described, that the other user fails to perform, or that the other user acts dishonestly. TradeTable does not verify the identity of users, does not inspect or authenticate any card, and does not guarantee that any trade will be completed or that any card is genuine or as described.

Any records the Service creates (including trade receipts, an "honesty ledger," timestamps, and any photos) are a contemporaneous record of what the participating users reported — not TradeTable's independent verification that those statements are true. Those records belong to the participants. You are free to download, keep, and use your records in your own private efforts to resolve a dispute or seek a remedy outside the Service — for example, in direct negotiation with the other user, a claim with your own payment provider, small-claims court, or a report to law enforcement. TradeTable does not mediate, arbitrate, adjudicate, or resolve disputes between users, and has no obligation to do so.

8. Disclaimer of warranties

THE SERVICE, INCLUDING ALL CONTENT, PRICE INFORMATION, AND TRADE RECORDS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES REGARDING THE ACCURACY, RELIABILITY, AVAILABILITY, OR COMPLETENESS OF THE SERVICE OR OF ANY PRICE INFORMATION, AND ANY WARRANTIES REGARDING THE EXISTENCE, QUALITY, SAFETY, LEGALITY, AUTHENTICITY, GRADE, OR VALUE OF ANY CARD OR THE TRUTHFULNESS OF ANY USER'S STATEMENTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRADETABLE AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CARDS, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY TRADE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN PARTICULAR, TRADETABLE IS NOT LIABLE FOR ANY LOSS ARISING FROM A CARD THAT IS COUNTERFEIT, ALTERED, MISGRADED, MISREPRESENTED, OR NOT AS DESCRIBED, OR FROM ANY OTHER USER'S CONDUCT.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE TOTAL SUBSCRIPTION FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless TradeTable and its owners, members, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service, (b) your User Content, (c) any trade you participate in, or (d) your violation of these Terms or of any law or third-party right.

11. Intellectual property; third-party marks; card data

The Service, including its software, design, and branding (excluding User Content and third-party materials), is owned by TradeTable and protected by intellectual-property laws.

TradeTable is an independent tool and is not affiliated with, sponsored by, endorsed by, or associated with The Pokémon Company, Nintendo, Game Freak, Creatures Inc., or any card manufacturer or grading company. All trademarks, card names, images, and related intellectual property are the property of their respective owners and are used, if at all, for identification and reference purposes only. Card data and images may be provided by third-party sources (e.g., pokemontcg.io) under their own terms, and are attributed accordingly.

12. Subscriptions, billing, auto-renewal, and cancellation

Some features ("Pro") require a paid subscription. Payments are processed by our third-party processor, Stripe; we do not store your full card details. By subscribing you agree to the following, which are also disclosed before you provide payment information:

  • Price and billing period. The Pro plan costs $2.99 per month or $25.00 per year (plus any applicable taxes), billed in advance.
  • Automatic renewal. Your subscription automatically renews at the end of each billing period, and your payment method is automatically charged the then-current price, until you cancel.
  • Consent. By subscribing you give your express, informed consent to these recurring charges.
  • How to cancel. You may cancel at any time from your Account Settings or by emailing [email protected]. Cancellation stops future renewals; it takes effect at the end of the current paid period, and you keep Pro access until then. We do not require you to call, chat, or complete any retention steps to cancel online.
  • Refunds. Subscription fees are non-refundable except where required by applicable law. We do not provide prorated refunds for a partial billing period.
  • Price changes. We may change subscription pricing prospectively; we will give you advance notice and the change will apply on your next renewal, which you may decline by canceling before it takes effect.
  • Acknowledgment. After you subscribe, we will send an acknowledgment with your plan terms and cancellation instructions.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including §§ 7–11, 14, and 15) will survive.

14. Dispute resolution

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring a claim in small-claims court if it qualifies. You and TradeTable each waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding.

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. If you opt out, you preserve your right to litigate disputes in court.

15. Governing law and venue

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws rules. Subject to § 14, the state and federal courts located in Missoula County, Montana will have exclusive jurisdiction.

16. Changes to these Terms

We may update these Terms. If we make material changes, we will notify you (for example, by email or an in-app notice) and, where appropriate, ask you to re-accept the updated Terms before continuing to use affected features. The "Last updated" date and version above indicate the current version. Your continued use after an update means you accept it.

17. Miscellaneous

  • Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision will be limited to the minimum extent necessary.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
